This website is operated by Luna Sounds Shop. Throughout these Terms, “we”, “us” and “our” refer to Luna Sounds Shop.

These Terms govern your use of lunasoundsshop.com and any order you place through the website. By placing an order, creating an account or using the website, you agree to these Terms.

ELIGIBILITY AND CUSTOMER ACCOUNTS

You must be legally capable of entering into a contract to place an order. If you are under 18, you must have permission from a parent or legal guardian.

You must provide accurate, complete and current information when creating an account or placing an order.

You are responsible for keeping your account details secure. Contact us promptly if you believe someone has accessed your account without permission.

PRODUCTS AND DESCRIPTIONS

We take reasonable care to ensure that product descriptions, photographs, prices, sizes and other information are accurate.

Colours may appear slightly different depending on your screen, lighting and the production process. Minor variations may also occur between products produced at different times. These variations will not affect your right to receive goods that materially match their description, are of satisfactory quality and are fit for purpose.

Please check the applicable size information before ordering clothing.

Some products are made to order or supplied by third-party production partners. We remain responsible for fulfilling our obligations to you regardless of which partner produces or dispatches the item.

All products are subject to availability. We may introduce reasonable quantity limits where necessary.

Vehicle names, manufacturer names, logos and other third-party trade marks belong to their respective owners. Unless expressly stated, their appearance does not imply sponsorship, approval or affiliation with Luna Sounds Shop.

PRICES AND PAYMENT

Prices are normally displayed in pounds sterling unless another currency is shown. Delivery charges and any other applicable charges will be displayed before you complete checkout.

International customers may be charged currency-conversion fees by their bank or payment provider. Import duties or taxes not collected at checkout may also apply.

We may change prices for future orders, but a price change will not affect an order we have already accepted.

If an obvious pricing error is discovered before dispatch, we will contact you. You may continue at the correct price or cancel for a full refund. We will not charge a higher price without your agreement.

Payment must be authorised through one of the payment methods offered at checkout.

ORDERS AND CONTRACT FORMATION

Placing an order is an offer to purchase the selected products.

A contract is formed when we send confirmation that your order has been accepted. Please check the order confirmation and contact us promptly if any information is incorrect.

We may cancel or refuse an order for a genuine reason, including:

• A product becoming unavailable
• Payment not being authorised
• Suspected fraud or unlawful activity
• An obvious pricing or description error
• Us being unable to deliver to the address provided

If we cancel an order after payment has been taken, we will issue a full refund.

ORDER CHANGES AND CANCELLATIONS

We cannot guarantee that an address, size, colour or product can be changed after production or dispatch has begun. This does not affect any cancellation or return rights provided by law.

PRODUCTION, SHIPPING AND DELIVERY

Some products are made to order, and orders containing different products may be produced or dispatched separately.

Available delivery services, estimated times and charges are shown during checkout. Delivery estimates are not guarantees, but we will fulfil orders within the timeframe required by applicable law unless a different timeframe has been agreed with you.

Risk of loss or damage passes to you when the goods are delivered to you or to a person you have nominated to receive them. It does not pass merely because a parcel has been handed to our chosen carrier.

RETURNS, REFUNDS AND FAULTY GOODS

Goods supplied to UK consumers must be as described, of satisfactory quality and fit for purpose. If an item is faulty, damaged, incorrect or not as described, contact lunasoundsshop@gmail.com with your order number.

Nothing in these Terms removes any right to a refund, repair, replacement or price reduction provided by law.

DISCOUNTS AND PROMOTIONS

Discount codes and promotional offers may have additional conditions, including an expiry date, eligible products or a minimum order value. These conditions will be displayed with the relevant promotion.

Unless stated otherwise, discount codes cannot be exchanged for cash or applied retrospectively to an order that has already been placed.

We may withdraw or correct a promotion where there has been a genuine technical or obvious pricing error. This will not affect an order already accepted unless we contact you and offer the choice of continuing on corrected terms or receiving a full refund.

INTELLECTUAL PROPERTY

The website and its content—including Luna Sounds branding, original artwork, graphics, photographs, text, videos and website design—are owned by or licensed to Luna Sounds Shop unless otherwise stated.

You may access the website and save or print order information for personal, non-commercial use.

You must not reproduce, distribute, sell, modify or commercially exploit our original content without permission. You may share ordinary links to our website and product pages.

Third-party names, designs, music, logos and trade marks remain the property of their respective owners.

REVIEWS AND CUSTOMER CONTENT

If you submit a review, photograph, comment or other content, you retain ownership of your content but give us a non-exclusive, royalty-free permission to display, reproduce and promote it in connection with Luna Sounds Shop.

You confirm that you have the right to submit the content and that it is not unlawful, abusive, misleading, defamatory or infringing on another person’s rights.

We may moderate or remove content where reasonably necessary, including content that is unlawful, fraudulent, unrelated to the product or contains personal information.

ACCEPTABLE USE

You must not use the website:

Our store is hosted by Shopify and may use third-party payment providers, production partners, delivery companies and applications.

When you follow a link to a separate third-party website, that website’s own terms and privacy policy will apply.

We are not responsible for unrelated content or services offered independently by third-party websites. However, using third-party partners does not remove our responsibilities for orders placed directly with Luna Sounds Shop.

Payment information is processed securely by Shopify and the payment provider selected during checkout. We do not receive or store your complete payment-card details.

WEBSITE AVAILABILITY AND ERRORS

We take reasonable care to keep the website available and accurate, but temporary interruptions may occur because of maintenance, security updates or technical problems.

If we discover an error that materially affects an accepted order, we will contact you and provide appropriate options, including cancellation and a full refund where applicable.

OUR RESPONSIBILITY TO YOU

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was made, were not caused by us, or resulted from information you supplied incorrectly where we could not reasonably correct it.

Our products are supplied for personal and domestic use. If you use a product for commercial or business purposes, we are not responsible for business losses such as lost profits, lost revenue or loss of business opportunity, except where the law states otherwise.

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Faulty, misdescribed or unsafe goods
• Breach of your statutory consumer rights
• Any liability that cannot legally be excluded or limited

EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for a delay caused by an event outside our reasonable control where we have taken reasonable steps to reduce its effects.

We will contact you where a significant delay is expected. If the delay becomes substantial, you may have the right to cancel and receive a refund for products not supplied.

SUSPENSION OR TERMINATION

We may suspend or terminate access to an account where we reasonably believe it is being used unlawfully, fraudulently or in serious breach of these Terms.

Any action taken will be proportionate and will not remove rights relating to an order already accepted or any refund owed.

CHANGES TO THESE TERMS

We may update these Terms to reflect changes to the website, our services or applicable law.

Updated Terms will be published on this page with a revised date. Changes will normally apply only to future website use and future orders. The version in effect when your order was accepted will continue to apply to that order unless a change is required by law.

SEVERABILITY AND WAIVER

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If we do not immediately enforce a provision, this does not mean we have permanently waived the right to enforce it later.

ENTIRE AGREEMENT

These Terms, together with the policies linked above and the information shown during checkout, form the agreement between you and Luna Sounds Shop regarding your order.

Nothing in this section limits any statement or information that you reasonably relied upon when deciding to purchase.

GOVERNING LAW AND COURTS

These Terms are governed by the laws of Northern Ireland to the extent permitted by law.

If you are a consumer living elsewhere, you retain any mandatory protections provided by the laws of your home country. UK consumers may bring proceedings in the courts applicable to the part of the UK where they live. Customers in other countries may also have the right to bring proceedings in their local courts.
